TERMS OF SERVICE

By accessing or using the Blitzify platform and services (the "Services"), you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and Blitz Industries, Inc. ("Blitzify," "we," "us," or "our").

If you are using the Services on behalf of an organization, you are agreeing to these Terms on behalf of that organization, and you represent that you have the authority to do so. In that case, "you" refers to both you individually and the organization.

If you do not agree to these Terms, do not access or use our Services.

To use our Services, you must be at least 16 years old and have the legal capacity to enter into a binding agreement. By using our Services, you represent and warrant that you meet these requirements.

Our Services are designed for business use. You represent that you are using the Services for legitimate business purposes and not for any unlawful activity.

To access most features of our Services, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date.

• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity that occurs under your account.
• You must notify us immediately of any unauthorized access to or use of your account.
• You may not share your account with others or transfer your account to another person without our prior written consent.

Blitzify reserves the right to suspend or terminate accounts that violate these Terms or that we determine, in our sole discretion, are being used inappropriately.

Our Services are offered on a subscription basis. Subscription tiers, included features, and pricing are described on our pricing page and may be updated from time to time with notice to existing subscribers.

Team and Workforce are self-serve subscription packages. Package features, included C10 credits, and pricing are described on our pricing page. Self-serve plan changes (including Team to Workforce upgrades) are not available in the product unless explicitly enabled and disclosed at checkout.

Included C10 credits are granted monthly even on annual billing. Unused C10 rolls over while your paid subscription remains active. When paid access ends, unused C10 is forfeited. Blitzify does not automatically charge for C10 overages.

By subscribing to a paid plan, you authorize Blitzify to charge the payment method on file for all applicable fees. All fees are stated in United States dollars unless otherwise specified.

• Fees are billed in advance on a monthly or annual basis depending on your selected plan.
• Blitzify uses Stripe, Inc. as its payment processor. Your payment information is subject to Stripe's privacy policy.
• Invoices are made available electronically through your account dashboard.
• If a payment fails, we will notify you and attempt to process the payment again. Continued failure to pay may result in suspension of your account.

Subscriptions renew automatically at the end of each billing period unless you cancel before the renewal date. Annual subscriptions renew on the anniversary of the subscription start date.

You may cancel your subscription at any time through your account settings or by contacting our support team. Cancellation takes effect at the end of the current billing period. You will retain access to the Services through the end of the period for which you have already paid.

You agree to use our Services only for lawful purposes and in accordance with these Terms. You agree not to use the Services:

• In any way that violates applicable local, national, or international law or regulation.
• To transmit, or procure the sending of, any unsolicited or unauthorized advertising or promotional material.
• To engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Services.
• To attempt to gain unauthorized access to any part of the Services or any systems or networks connected to the Services.
• To use automated means to access, scrape, or index the Services without our express written permission.
• To impersonate or attempt to impersonate Blitzify, a Blitzify employee, another user, or any other entity.

Blitzify reserves the right to terminate access for any user who violates this Acceptable Use Policy.

Our platform provides AI-powered agents that perform tasks autonomously on your behalf. By using our AI services, you acknowledge and agree to the following:

• AI agents operate based on configurations, parameters, and instructions you provide. You are responsible for the accuracy and completeness of those inputs.
• AI-generated outputs may contain errors, inaccuracies, or omissions. You are responsible for reviewing and validating all AI outputs before acting on them.
• You must not use AI agents to generate, distribute, or act upon content that is illegal, harmful, deceptive, or violates the rights of others.
• Blitzify does not warrant that AI outputs will meet your specific requirements or expectations.

Specialists may draft, recommend, and prepare work autonomously within boundaries you configure. Consequential actions require your explicit approval. Program Name: Blitzify SMS Communications

Brand / Sender: Blitzify, operated by Blitz Industries, Inc.

Enrollment. Users voluntarily enroll in Blitzify SMS programs by providing a mobile phone number and separately selecting one or both of the optional, unchecked SMS consent checkboxes on the Request a Demo form at https://www.blitzify.ai/request-demo:

• Informational and service SMS consent, demo requests, appointments, requested information, account notifications, onboarding, and customer support.
• Marketing and promotional SMS consent, product announcements, offers, and sales follow-up. Marketing consent is collected separately from informational/service consent.

This is the only enrollment path. Providing a phone number alone does not constitute enrollment. Selecting one consent type does not grant the other.

Consent is not a condition of purchase. Accepting these Terms does not grant SMS consent. You may request a demonstration, subscribe to a Blitzify plan, and use Blitzify Services without enrolling in SMS communications.

Message frequency varies based on your interaction with Blitzify.

Message and data rates may apply. Standard message and data rates charged by your wireless carrier may apply. Blitzify is not responsible for any charges your carrier assesses.

Carrier liability.Participating carriers are not liable for delayed or undelivered messages. Delivery is subject to the capabilities and availability of your carrier's network.

To opt out, reply STOP, END, CANCEL, QUIT, or UNSUBSCRIBE to any text message from Blitzify. You will receive a confirmation and will not receive further messages unless you re-enroll by replying START. To request assistance, reply HELP or contact us at support@blitzify.ai.

Your responsibilities. You are responsible for providing a valid mobile phone number at the time of enrollment. If your number changes, notify Blitzify at support@blitzify.ai, opt out of the previous number, and re-enroll with your new number to avoid messages being delivered to the wrong recipient.

Blitzify may modify, suspend, or discontinue the SMS program at any time, subject to applicable legal and regulatory requirements. We will provide reasonable notice of material changes where required.

Our Services may allow you to upload, submit, store, or transmit content, including data, documents, and configurations ("User Content"). You retain ownership of your User Content.

By submitting User Content to our Services, you grant Blitzify a limited, worldwide, non-exclusive, royalty-free license to use, process, and store your User Content solely to provide and improve our Services. We do not claim any ownership rights in your User Content.

You represent that you have all rights necessary to submit your User Content and that it does not violate any third-party rights.

The Services and all associated content, features, and functionality (including but not limited to software, text, graphics, logos, and the design and arrangement thereof) are owned by Blitzify and are protected by copyright, trademark, and other intellectual property laws.

Nothing in these Terms grants you any right, title, or interest in our intellectual property. You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any part of our Services or content without our prior written consent.

We strive to maintain high availability of our Services, but we do not guarantee that the Services will be uninterrupted, error-free, or available at all times. Scheduled maintenance, upgrades, and circumstances beyond our control may result in temporary unavailability.

Our Services may integrate with or link to third-party services, platforms, and applications. These integrations are provided for your convenience. Blitzify is not responsible for the content, privacy practices, or terms of any third-party services.

Your use of any third-party services is governed by the terms and privacy policies of those services. We encourage you to review those policies before connecting third-party services to your Blitzify account.

You may terminate your account at any time by following the cancellation process in your account settings or by contacting us at support@blitzify.com.

Blitzify may suspend or terminate your access to the Services at any time, with or without cause, with or without notice. Reasons for termination may include, but are not limited to, violation of these Terms, non-payment, or activity that we determine is harmful to other users or to Blitzify.

Upon termination, your right to use the Services will immediately cease. Sections of these Terms that by their nature should survive termination will remain in full force and effect.

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BLITZIFY'S AGGREGATE LIABILITY ARISING FROM THESE TERMS OR THE SERVICES IS LIMITED TO THE AMOUNTS YOU PAID TO BLITZIFY IN THE TWELVE MONTHS BEFORE THE CLAIM. READY FOR LEGAL REVIEW, accurate to current product behavior; not attorney-certified.

You agree to defend, indemnify, and hold harmless Blitzify and its officers, directors, employees, contractors, agents, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Services.

We reserve the right to modify these Terms at any time. When we make material changes, we will provide notice by updating the "Last Updated" date at the top of this page and, where appropriate, providing additional notice such as an in-product notification or email to the address associated with your account.

Your continued use of the Services after any changes constitutes your acceptance of the updated Terms. If you do not agree to the modified Terms, you should discontinue use of the Services.
